The following general business connections count to all legal shops, deliveries and achievements, between the customer and the sullus GmbH und Co. KG without concurrent presence of the customer and our employees are completed (e.g., by means of electronic order system, e-mail, fax, phone order, letter).
Provided that other terms and conditions are not recognised expressly in writing, exclusively our terms and conditions count; other conditions do not become contract contents, even if is not expressly contradicted – rather it is also contradicted for the future of your inclusion.
Divergences and changes of the terms and conditions and become first with written confirmation of the management of the sullus GmbH und Co. KG efficiently. Employees / representatives are not entitled to agree orally on changes, on assents or guarantees.
Offer and completion of a contract
In catalogues, advertisement, Internet pages or similar to described achievements and deliveries are ordered by the customer obligatorily (contract offer).
With use of our electronic order systems this order is not already with choice or infix in the goods basket. Rather "ordering" a contract offer is delivered only after choice by dispatch kind and mode of payment by click on the button.
A contract offer is accepted by us within 3 working days after entrance by e-mail, in writing, by fax, to telephone recall, sending of light of delivery or dispatch confirmation or the execution of the delivery, otherwise it is worth as rejected. Only our acceptance leads to a contract. A possible cancellation right is not touched through this.

You can revoke your contract explanation within two weeks without information of reasons in text form (e.g., letter, fax, e-mail) or by return of the thing. The term begins at the earliest with preservation of this cancellation instruction in text form and the entrance of the bought product with the receiver. Nevertheless, a cancellation right does not pass paragraph 4 No. 1, No. 2 Civil Code according to §312d if the goods to be delivered are made after customer specifications or are cut unambiguously on the personal needs, as well as with software (provided that the delivered data carriers have been unsealed).
Cancellation results
In case of an effective cancellation the achievements received on both sides are to be returned and if necessary pulled uses (e.g., interest) are to be published. If you are not able to do to us the received achievement all or part not or only in made worse state, you must perform to us in this respect if necessary value substitute. With the surrender of things this does not count if the deterioration of the thing is to be led back exclusively on their check - as she would have been possible to you possibly in the retail shop. For the rest, you can avoid the value obligation to indemnify, while you do not take the thing like an owner in use and omit from everything what impairs their value. Packets, which are are fit for shipping are to be sent back. You have to carry the costs of the return if the delivered product of the ordered ones corresponds and if the price of the thing to be sent back does not exceed an amount of 40 euros or if you have not produced the consideration or a by contract agreed hire-purchase with a higher price of the thing at the time of the cancellation yet. Otherwise the return is free for you. Things, which are not fit for shipping are fetched at you. You must fulfil obligations to the allowance of payments within 30 days after sending your cancellation explanation.

Storage of the contract text
The contract text is not stored by us and cannot be called away after end of the order process any more. It is recommended to print out the order data and the valid terms and conditions with or after end of the order process and to store away.
Delivery, prices, forwarding expenses
Obliging dates of delivery or terms of delivery need the written form. The observance of our obligation of delivery assumes if necessary timely and proper fulfilment of the obligations of the buyer or customer.
Provided that differently does not agree, adequate terms are to be granted for deliveries taking into account usual or informed selfsupply terms. We are entitled to partial achievements in reasonable circumference, additional costs do not originate for you through this. Provided that other does not agree, we choose packaging and dispatch at reasonable discretion. Packaging is not taken back.
It are worth the prices at the time of the order, as well as they were shown on the internet pages. All prices contain the in each case legal sales tax. This becomes given while sending the order, as well as on the calculation again.
The forwarding expenses amount depending on place of delivery:

Precash: Article to 2 kg - 4.00 euros; in addition, on inquiry.
Cash on delivery: Forwarding expenses like precash, in addition, per delivery 4.00 euros COD and 2.00 euros for the Deutsche Post AG.
Dispatch in EU states and Switzerland:
Precash: Article to 2 kg - 8.60 euros, in addition, and other mode of payment on inquiry.
Dispatch in other states:
Forwarding expenses in the electronic order system allow to register or ask for, partly only precash possibly.
Select, e.g., in the electronic order system your articles according to demand and conclude the order process with "precash". Orders are also accepted by e-mail or fax. You receive the necessary information for the transfer with e-mail.
The following regulations count, in addition, according to the agreed mode of payment:
- Selfcollection
We call if the desired product is in stock. No dispatch fees attack it. The product is paid cash against handing over.
- Precash
You transmits order number and account connection got from us. You transfer the amount to be paid to the given account. As an intended purpose you give please your name and the order number. As soon as your payment is entered with us and the ordered product is available, this of us is dispatched.
- Credit card
It are worth the conditions of the maps-exhibiting enterprise. After payment the ordered product is dispatched, as soon as this product is available.
- Order cash on delivery
The dispatch occurs if the desired product is in stock you pay with the preservation of the delivery directly to the postman or in your post branch.
- Delivery on calculation
Calculations are handed over by delivery of the product or are sent by letter. These are due with a term of 10 days without descount. Other payment purposes need the written form.
Reservation of proprietary rights
The sullus on-line shop reserves itself the property in the delivered product up to final and entire payment of the purchase price and any forwarding expenses. With accesses of third to the reservation product the buyer has to point to our property and to inform us immediately of it. Device of the buyers in default we are entitled to take back the reservation product or to require the cession of the publication claims of the buyer against third. In the withdrawal as well as in the attachment of the reservation product by us don't exist resignation of the contract.
Warranty, guarantee
The guarantee is regulated according to the legal regulations.
We grant basically no guarantee on goods and services. Provided that manufacturers grant guarantees, we resign if necessary existing rights with pleasure to the customer and support this in the way of the goodwill achievement by the penetration. Possible guarantee claims leave the guarantee untouched.

Liability limitation
Our precontractual, contractual and external-contractual liability is limited to intention and coarse carelessness, as far as it does not concern the injury of contract-essential duties or the injury of life, body or health. Same counts to the liability of our employees and fulfilment assistant. The liability according to the product liability law remains untouched from this.
Back end packaging
The return should be carried out only in the original packaging intended for it or in the exceptional case in a comparable spare packaging. Note please that electronic components must be packed antistatic. The original packaging of the manufacturer guarantees this by special, EMV fair cardboards or plastic bags and, hence, should be used as far as possible!
Legal choice, clause
On the legal relationships between us and the buyer German right to the exclusion of the regulations of the Viennese UN-purchase right (CISG) finds application.
Should a contract regulation be ineffective – including regulations of these terms and conditions - all or part or lose later her validity, the validity of the remaining regulations should not be touched through this. This does not count if the holding on in the contract showed an unreasonable hardness for a party.
Vvenue
If the customer is a businessman, juridical person of the public right or public law special property, Dresden is agreed as a legal venue.
Tips to the data protection
As far as possibilities for the input of personal data exist, such data are treated confidentially considering valid data protection-juridical regulations. Personal data are only raised and used, as far as it is necessary for the content arrangement or winding up of the respective contract. The customer can require any time information about these stored data. He can require the deletion of personal data, provided that the contract was unwound completely and the safekeeping of the data is not prescribed. Not personal access data are stored for statistical purposes and are used.
